Elle permet d’étudier la pénalisation de la vie internationale. Elle semble pouvoir rendre compte de la réponse judiciaire à la rancœur internationale au regard des grands faits criminels ; quel qu’en fut le territoire de commission.Cette thèse porte sur la notion de recevabilité devant la Cour pénale internationale. Avec la création de la CPI, la justice pénale internationale prend une dimension nouvelle. La pratique de la Cour est encore récente. L’étude est le prétexte pour examiner le fonctionnement de la Cour pénale internationale. Les Etats ont tenté de limiter la capacité de recevoir de la Cour. Ils l’ont ainsi fondée sur le principe de la complémentarité. Elle supplée l’inaction ou l’action défaillante des Etats, qui ont le devoir de poursuivre les auteurs de crimes internationaux. L’article 17 du Statut de Rome énonce les exceptions permettant de déclarer une affaire recevable devant la CPI. Ainsi, la recevabilité d’une affaire ayant fait l’objet d’une enquête ne sera retenue que s’il est prouvé que les Etats n’ont pas l’intention de mener véritablement à bien les poursuites. Et, que par ailleurs, le seuil de gravité de l’affaire est atteint. Le caractère universel de la compétence de la CPI est battu en brèche par les conditions de recevabilité. On analyse la recevabilité comme une condition de compétence à juste titre, car c’est bien le manquement de l’Etat à assurer l’effectivité des poursuites qui justifie que l’affaire soit déclarée, par la Cour elle-même, recevable. Les conditions requises pour que la Cour puisse agir, force est de constater l’implication du système de recevabilité tant sur l’organisation de la Cour que sur ses rapports avec les Etats. Celles-ci ne sont pas négligeables. De fait, le système de recevabilité est amené à évoluer. Il se caractérise par sa capacité à influencer le droit interne. Ainsi, la décision de recevoir doit amener les Etats à adapter leur droit interne. La viabilité de la Cour, à long terme, dépend du maintien d’une synergie de coopération avec les juridictions nationales, des États parties et d'autres Etats. Le système de recevabilité tend à mettre en évidence des indicateurs émergents dans la pratique de la Cour pénale internationale. C’est notamment le réalignement frappant des rôles des acteurs internationaux et la relation nouvelle qui s’instaure entre les Etats et la Cour. Le système de recevabilité de la Cour tend à éroder le principe de la souveraineté de l'Etat, sans être elle-même balayée par l'opposition catégorique des Etats souverains. Admissibility is the heart of the judicial process. It studies the criminalization of international life. It seems to account for the judicial response to the international resentment against the great criminal acts, whatever was the territory of commission.This thesis deals with the notion of admissibility before the ICC. With the creation of the ICC, International Criminal Justice is a new dimension. The practice of the Court is still new. The study is an excuse to investigate the operation of the ICC. States have tried to limit the ability to receive from the Court. They did so based on the principle of complementarity. It compensates the action or inaction of failing states, which have a duty to prosecute international crimes. Article 17 RS sets out exceptions to declare a case admissible before the ICC. Thus, the admissibility of a case which is the subject of an investigation will be accepted only, if it is shown that States did not intend genuinely to carry out prosecutions. And that furthermore, the threshold of gravity of a case is reached. The universal nature of the jurisdiction of the ICC is undermined by the conditions of admissibility. Analyzing the admissibility of competence as a condition rightly, for it is the failure of the state to ensure effective prosecution to justify that the case will be declared by the Court itself, admissible. The requirements for the Court to act, it is clear involvement of the system of admissibility as on the organization of the Court that its relationship with the United States. These are not insignificant. In fact, the system will evolve admissibility. It is characterized by its ability to influence the law. Thus, the decision to receive should encourage States to adapt their domestic law. The viability of the Court, in the long run depends on maintaining a synergy of cooperation with national courts of States Parties and other States. The system of admissibility tends to highlight indicators emerging in the practice of the International Criminal Court. This is especially striking realignment of the roles of international actors and the new relationship established between the States and the Court. Empirical expressions for gas hydrate stability law, its volume fraction and mass-density at temperatures 273.15 K to 290.15 K Auteur(s) : Lu, Zhengquan Sultan, Nabil Éditeur(s) : Terrapub Résumé : A series of empirical expressions for predicting gas hydrate stability, its volume fraction out of pore space and gas hydrate mass-density were established in different systems in consideration of gas composition (CH4, C2H6, H2S) and salinity (NaCl, seawater), and pore size at temperature between 273.15 and 300 K, based on our gas hydrate thermodynamic model (Sultan et al., 2004b, c). Six of the developed expressions for predicting gas hydrate stability were validated against the available published experimental data and they were also compared with other models. At temperature 273.15 to 290.15 K, the ARDPs (Average Relative Deviation of Pressures between the prediction and the experimental data) have shown that these empirical expressions are in agreement with the experimental data as well as other models, indicating their reliability of predicting gas hydrate stability for these systems. At higher temperatures, the empirical predictions for gas hydrate stability do not well reproduce the experimental data, because they are based on van der Waals model. The empirical expressions for predicting gas hydrate stability in the systems of CH4 + H2S + H2O, CH4 + seawater + poresize, CH4 + H2S + NaCl and CH4 + CO2 + NaCl, and for evaluating gas hydrate fraction and its density need further validation due to lack of available published experimental data. However, the empirical expressions for gas hydrate fraction and its density show that the effects of pore size and salinity are negligible; gas hydrate fraction will increase if methane concentration continuously increases relatively in excess of methane solubility and decreases with pressure within gas hydrate stability zone, which is well consistent with data of natural gas hydrates in Cascadia; gas hydrate density tends to increase with ethane percentage and decrease with pressure. Alors que la mondialisation est souvent décriée comme anti-démocratique, nous démontrerons que d’un point de vue strictement juridique, il apparaît que la réalité est plus nuancée. Nous passerons en revue les critiques de la mondialisation liées à la perte de souveraineté de l’Etat, qui nous paraissent devoir être relativisées à la fois dans son étendue et dans son impact sur la démocratie. Nous montrerons comment le droit international surmonte ces difficultés en permettant un nouvel équilibre entre Etat et individu sur la scène internationale, et comment à un modèle de démocratie traditionnel fondé sur l’Etat est en train de succéder une démocratie fondée sur la société civile transnationale. Enfin, nous évoquerons le rôle essentiel du juge afin de préserver démocratie et état de droit dans l’ordre international, malgré les limites qui lui sont inhérentes. This article aims to critically analyse the concept of globalization, from a legal standpoint. While globalization is often criticized as anti-democratic, we demonstrate that from a strictly legal point of view, the reality is subtler. We review the criticisms of globalization related to the loss of state sovereignty, which we believe need to be put into perspective in both their extent and their impact on democracy. We show how international law overcomes the new challenges due to globalization by allowing a new balance between the State and the Individual on the international plane. We then show that the classical model of democracy based on the State is being superseded by a democracy based on transnational civil society. Finally, we discuss the essential role of the judge to preserve democracy and rule of law in the international order, despite the limitations inherent to his competences. In order to assess additional drivers ofdeforestation due to gold-mining, we focused on the national scale and highlighted theheterogeneity of the response to gold-prices under different political contexts. Deforestation dueto gold-mining over the Guiana Shield occurs mainly in Guyana and Suriname. On the contrary,past and current repressive policies in Amapá and French Guiana likely contribute to thedecorrelation of deforestation and gold prices. In this work, wefinally present a case studyfocusing on French Guiana and Suriname, two neighbouring countries with very different levelsof law enforcement against illegal gold-mining. We developed a modelling framework to estimatepotential deforestation leakages from French Guiana to Suriname in the border areas. Based onour assumptions, we estimated a decrease in deforestation due to gold-mining of approx. 4 300hectares in French Guiana and an increase of approx. 12 100 hectares in Suriname in response tothe active military repression of illegal gold-mining launched in French Guiana.Gold-mining in the Guiana Shield provides challenging questions regarding REDDþimplementation. These questions are discussed at the end of this study and are important topolicy makers who need to provide sustainable alternative employment to local populations inorder to ensure the effectiveness of environmental policies. When geothermal reservoir are assumed to be composed of pure water, the transfer of mass and energy is classically described by two balance equations: mass balance equation and the energy balance equation. In addition to those equations, fluid velocity ist classically given by the Darcy law while thermodynamic properties, inferred from theoretical or empirical equations of state, are used to close the mathematical system. Once this system is closed, there exist different solutions. The first one is to solve for pressure and temperature with a variable switch to saturation in the two-phase region (e.g. TOUGH2). The second one is to solve for pressure and enthalpy to increase stability of phase transition between single and two-phase states (e.g. Hydrotherm). We adopted the second option and chose te use a splitting method to get rid of the complexity of coupling equations and a finite volume method for the spatial discretization. Selecting object-oriented languages, we developed a multi-language framework, combining Python, Fortran and a C++ implementation of IAPWS (from the freesteam project) including the supercritical equations, in porous media velocity is given by Darcy law and to close the system physical properties are determined by the IAPWS-IF97 thermodynamic formulation. We resolve the equations in pressure and enthalpy instead of pressure and temperature in order to increase stability and to handle easier the passage from a single-phase to a two-phase system. We solve the system by using a splitting method - to get rid of the complexity of coupling equations - and a finite volume method. We offer some freedom to users thanks to the implementation of several methods like explicit or implicit Euler, Runge-Kutta or BDF2 for time solvers or GMRES and BICGSTAB for the linear solver. We can handle several boundary conditions like no-flow - describing a boundary which can not exchange matter with the exterior - or like a mixed-therm condition - a Dirichlet condition to the pressure and a Dirichlet or an outflow condition to the temperature in order to describe a recharge or a discharge zone - ... We're developing a multi-language framework, combining Python, Fortran and the C++ implementation of IAPWS (from the freesteam project). All these languages are object-oriented. We've applied this simulation model to the dogger in Paris, France, to several one-dimensional systems and a two-dimensional one made by Coumou with the CSMP++ platform. The dogger is a reservoir exploited to produce heat by pumping water at 70 and reinjecting it in the reservoir at 40. In the one-dimensional systems we wanted to observe the process of heat transfer from a higher temperature boundary to a smaller one in a high-energy domain. The last simulation shows the natural convection of water in a fault. For every simulation we compared the solutions we found with an other code (TOUGH2 or CSMP++) and they agreed. The next step will be to model the geothermal plant in Guadeloupe, West Indies. It's the only place in France - and in the West Indies so far - producing electricity with the earth power. The temperature can reach up to 1000 and the pressure range is around a few hundreds MPa. In some surface zones we can see two-phase water at atmospheric pressure. In the 1980s Bouillante was a laboratory for France. Since 1995 Bouillante has given 30GWh electricity a year to the Guadeloupeans.
