Résumé : This paper examines the notion of sovereignty in an ever-changing postmodern world and its implications for tourism. New spaces have been created, old spaces have been united, and traditional barriers have been torn down. These and other manifestations of globalization are particularly poignant in island and coastal destinations. Empirical examples will be provided from Europe, North America, the Caribbean, and the Arctic to illustrate shifting notions of absolute sovereignty into supranationalist associations, cross-border cooperative relations, and in some cases, more austere extremes in asserting state sovereignty. All of these changes have salient implications for tourism from planning, marketing, and policy perspectives.

Résumé : Cet article vise à mener une analyse juridique du concept de mondialisation. Alors que la mondialisation est souvent décriée comme anti-démocratique, nous démontrerons que d’un point de vue strictement juridique, il apparaît que la réalité est plus nuancée. Nous passerons en revue les critiques de la mondialisation liées à la perte de souveraineté de l’Etat, qui nous paraissent devoir être relativisées à la fois dans son étendue et dans son impact sur la démocratie. Nous montrerons comment le droit international surmonte ces difficultés en permettant un nouvel équilibre entre Etat et individu sur la scène internationale, et comment à un modèle de démocratie traditionnel fondé sur l’Etat est en train de succéder une démocratie fondée sur la société civile transnationale. Enfin, nous évoquerons le rôle essentiel du juge afin de préserver démocratie et état de droit dans l’ordre international, malgré les limites qui lui sont inhérentes.
This article aims to critically analyse the concept of globalization, from a legal standpoint. While globalization is often criticized as anti-democratic, we demonstrate that from a strictly legal point of view, the reality is subtler. We review the criticisms of globalization related to the loss of state sovereignty, which we believe need to be put into perspective in both their extent and their impact on democracy. We show how international law overcomes the new challenges due to globalization by allowing a new balance between the State and the Individual on the international plane. We then show that the classical model of democracy based on the State is being superseded by a democracy based on transnational civil society. Finally, we discuss the essential role of the judge to preserve democracy and rule of law in the international order, despite the limitations inherent to his competences.

Résumé : Indigenous territories comprise extensive areas of tropical forest and hold significant social and conservation value. Today, they are subject to various constraints and opportunities, and face many territorial transformations. These transformations are complex and multifaceted. They involve the adoption of new production and consumption modes, the modification of forms of social organisation and identity and territorial claims. However, the links between these on-going processes are still poorly understood, and make difficult to appreciate the adaptation dynamics of indigenous common natural resources management. This thesis is particularly concerned with the territorial dynamics of the Wayãpi and Teko indigenous people of the municipality of Camopi in French Guiana. It integrates methods that include land use analysis using remotely sensed data, socio-economic and agricultural systems analysis at the household scale, and empirical analysis on the influence of identity claims, kinship networks, and conservation policies. It shows that despite the residential settlement around local towns, the growth of cash income from wage labour and welfare, associated with strong kinship networks, allows the revival of mobility and the diversification of indigenous territorialities. Environmental policies implemented on the territory involve processes of identity and territorial claims and motivate the construction of a collective project of endogenous local development. A comparative approach with the situation of the wayãpi people living in Brazil and evolving in a completely different institutional, socio-economic and environmental context shows similar dynamics. Indigenous peoples of these two sites adopt "multi-local" land use systems, allowing them to extend their territory occupation and taking part of a broader dynamic of territorial and identity affirmation. They articulate forest and local town environments. This multi-local land use system can be interpreted as a new form of environmental governance, which overcomes the access difficulties to natural resources around local towns and ensures their sovereignty over the territory.
Les territoires amérindiens couvrent de vastes étendues de forêts tropicales et possèdent une forte valeur sociale et environnementale. Soumis à des contraintes et opportunités variées, ils sont de nos jours le siège de nombreuses transformations territoriales. Ces transformations sont complexes et multiformes. Elles impliquent l'adoption de nouveaux modes de production et de consommation, le réajustement des formes d'organisation sociale et des dynamiques de réaffirmation identitaire et territoriale. Or les liens entre tous ces processus sont encore mal compris, et rendent délicate la compréhension des dynamiques d'adaptation des systèmes amérindiens de gestion des ressources communes. Cette thèse s'intéresse particulièrement aux dynamiques territoriales des Amérindiens wayãpi et teko de la commune de Camopi en Guyane française. Elle intègre des données sur l'occupation du sol obtenues par télédétection, des données socio-économiques et productives à l'échelle des ménages et des données qualitatives sur les processus identitaires, les réseaux de parenté, les politiques de conservation et la gouvernance du territoire. Elle montre que malgré la sédentarisation de l'habitat autour des bourgs locaux, la croissance des revenus monétaires issus des emplois salariés et des aides sociales, combinée avec le maintien de réseaux de parenté et d'entraide, permet une redynamisation des systèmes de mobilité et une diversification des territorialités amérindiennes. De plus, les politiques environnementales mises en place sur le territoire impliquent des processus de territorialisation et de revendications identitaires et motivent la construction collective d'un projet de développement local endogène. Une approche comparative avec la situation des Amérindiens wayãpi vivant au Brésil et évoluant dans un contexte socio-économique, institutionnel et environnemental bien différent montre des dynamiques similaires. Les Amérindiens de ces deux pays adoptent des systèmes d'exploitation du territoire multi-locaux, leur permettant d'étendre leur occupation du territoire et s'inscrivant dans une dynamique de réaffirmation identitaire et territoriale. Ils articulent ainsi les espaces de la forêt et des bourgs. Cette forme d'exploitation multi-locale du territoire peut être interprétée comme une nouvelle forme de gouvernance environnementale, qui leur permet de contourner les difficultés d'accès aux ressources naturelles autour des bourgs et d'affirmer leur souveraineté sur le territoire.

Résumé : While ever facing risks and vulnerabilities, small island states continue impress with a wily and adroit commercialisation of imaginative ‘resources’: these include discrete tax shelters, citizenship, internet domains, philately, generic drugs, place-branded goods and geostrategic services (including tourism). However, the option to migrate is increasingly fraught by the regulations of the receiving countries, wary of heightened security concerns, stagnating economies and rising xenophobia. Comparisons with subnational island jurisdictions, which treasure their autonomy but are not interested in full sovereignty, are instructive.
Plus que jamais exposés aux risques et vulnérabilités, les petits États insulaires continuent d'impressionner par leur commercialisation rusée et habile de « ressources » imaginatives: il s'agit notamment de discrets abris fiscaux, de citoyenneté, de domaines Internet, de médicaments génériques, de produits de marque et services géostratégiques (incluant le tourisme). Toutefois, la possibilité de migrer de plus en plus difficile face aux réglementations des pays d'accueil d’une méfiance accrue en matière de sécurité, de stagnation économique et de montée de la xénophobie. Les comparaisons avec les provinces et territoires insulaires infranationales, qui chérissent leur autonomie mais ne sont pas intéressés par une pleine souveraineté, sont instructifs.

Résumé : La recevabilité est le cœur de la procédure judiciaire. Elle permet d’étudier la pénalisation de la vie internationale. Elle semble pouvoir rendre compte de la réponse judiciaire à la rancœur internationale au regard des grands faits criminels ; quel qu’en fut le territoire de commission.Cette thèse porte sur la notion de recevabilité devant la Cour pénale internationale. Avec la création de la CPI, la justice pénale internationale prend une dimension nouvelle. La pratique de la Cour est encore récente. L’étude est le prétexte pour examiner le fonctionnement de la Cour pénale internationale. Les Etats ont tenté de limiter la capacité de recevoir de la Cour. Ils l’ont ainsi fondée sur le principe de la complémentarité. Elle supplée l’inaction ou l’action défaillante des Etats, qui ont le devoir de poursuivre les auteurs de crimes internationaux. L’article 17 du Statut de Rome énonce les exceptions permettant de déclarer une affaire recevable devant la CPI. Ainsi, la recevabilité d’une affaire ayant fait l’objet d’une enquête ne sera retenue que s’il est prouvé que les Etats n’ont pas l’intention de mener véritablement à bien les poursuites. Et, que par ailleurs, le seuil de gravité de l’affaire est atteint. Le caractère universel de la compétence de la CPI est battu en brèche par les conditions de recevabilité. On analyse la recevabilité comme une condition de compétence à juste titre, car c’est bien le manquement de l’Etat à assurer l’effectivité des poursuites qui justifie que l’affaire soit déclarée, par la Cour elle-même, recevable. Les conditions requises pour que la Cour puisse agir, force est de constater l’implication du système de recevabilité tant sur l’organisation de la Cour que sur ses rapports avec les Etats. Celles-ci ne sont pas négligeables. De fait, le système de recevabilité est amené à évoluer. Il se caractérise par sa capacité à influencer le droit interne. Ainsi, la décision de recevoir doit amener les Etats à adapter leur droit interne. La viabilité de la Cour, à long terme, dépend du maintien d’une synergie de coopération avec les juridictions nationales, des États parties et d'autres Etats. Le système de recevabilité tend à mettre en évidence des indicateurs émergents dans la pratique de la Cour pénale internationale. C’est notamment le réalignement frappant des rôles des acteurs internationaux et la relation nouvelle qui s’instaure entre les Etats et la Cour. Le système de recevabilité de la Cour tend à éroder le principe de la souveraineté de l'Etat, sans être elle-même balayée par l'opposition catégorique des Etats souverains.
Admissibility is the heart of the judicial process. It studies the criminalization of international life. It seems to account for the judicial response to the international resentment against the great criminal acts, whatever was the territory of commission.This thesis deals with the notion of admissibility before the ICC. With the creation of the ICC, International Criminal Justice is a new dimension. The practice of the Court is still new. The study is an excuse to investigate the operation of the ICC. States have tried to limit the ability to receive from the Court. They did so based on the principle of complementarity. It compensates the action or inaction of failing states, which have a duty to prosecute international crimes. Article 17 RS sets out exceptions to declare a case admissible before the ICC. Thus, the admissibility of a case which is the subject of an investigation will be accepted only, if it is shown that States did not intend genuinely to carry out prosecutions. And that furthermore, the threshold of gravity of a case is reached. The universal nature of the jurisdiction of the ICC is undermined by the conditions of admissibility. Analyzing the admissibility of competence as a condition rightly, for it is the failure of the state to ensure effective prosecution to justify that the case will be declared by the Court itself, admissible. The requirements for the Court to act, it is clear involvement of the system of admissibility as on the organization of the Court that its relationship with the United States. These are not insignificant. In fact, the system will evolve admissibility. It is characterized by its ability to influence the law. Thus, the decision to receive should encourage States to adapt their domestic law. The viability of the Court, in the long run depends on maintaining a synergy of cooperation with national courts of States Parties and other States. The system of admissibility tends to highlight indicators emerging in the practice of the International Criminal Court. This is especially striking realignment of the roles of international actors and the new relationship established between the States and the Court. The system of admissibility of the Court tends to erode the principle of state sovereignty, without itself being swept by the opposition of sovereign states.
