INRA, CFCS Description : In the Global South, improvement of agricultural outputs is eagerly awaited. While by 2050, its population will double areas devoted to agriculture will decrease exacerbating undernutrition of the poor. Unfortunately, the demand for fresh locally-produced meat products is not satisfied yet in the tropics. So, efficiency in animal productions is essential to allow coverage of protein nutritional needs of people, both in quality and quantity. In the Caribbean territories mixed farming systems are the most common farming systems (about 80%) and can constitute a solution to reach food sovereignty in such limited and isolated spaces. Lessons to be learned from these systems involve improving animal performance while respecting the natural balance with environment and maintaining the multi-functionality of plants and animals. Firstly, the natural (or selected) comfort zone of animal and plants must fit with the farm conditions, insuring thereby animal survival and welfare. Enhancement of adaptation to stresses (biotic, abiotic and socio- economic) in species or animal genotypes is a key element implying their equilibrium with the farm environment. This approach underpins for the farmer an integrated management of animal health, nutrition, genetics, reproduction, in close relationship with other compartments of the farming system. Secondly, animal adaptation may be completed by resilience ability within systems. Animals have to produce although facing stresses. Finally, the animal must be efficient that is to say must reconcile physiological functions of production, reproduction with adaptation functions. This optimization leads to decreased inputs and to overall efficiency of mixed farming systems at the end. The aim of the breeder is to choose the animal producing the best balance between output-reproduction-adaptation, at the individual or the flock scale combining genetic and physiological diversity. The underlying idea is to give to humans and animals their right place in the food chain taking into account the farmers? skills and wills. This idea is included in the agroecological approach and may give guidelines for food sovereignty worldwide. Alors que la mondialisation est souvent décriée comme anti-démocratique, nous démontrerons que d’un point de vue strictement juridique, il apparaît que la réalité est plus nuancée. Nous passerons en revue les critiques de la mondialisation liées à la perte de souveraineté de l’Etat, qui nous paraissent devoir être relativisées à la fois dans son étendue et dans son impact sur la démocratie. Nous montrerons comment le droit international surmonte ces difficultés en permettant un nouvel équilibre entre Etat et individu sur la scène internationale, et comment à un modèle de démocratie traditionnel fondé sur l’Etat est en train de succéder une démocratie fondée sur la société civile transnationale. Enfin, nous évoquerons le rôle essentiel du juge afin de préserver démocratie et état de droit dans l’ordre international, malgré les limites qui lui sont inhérentes. This article aims to critically analyse the concept of globalization, from a legal standpoint. While globalization is often criticized as anti-democratic, we demonstrate that from a strictly legal point of view, the reality is subtler. We review the criticisms of globalization related to the loss of state sovereignty, which we believe need to be put into perspective in both their extent and their impact on democracy. We show how international law overcomes the new challenges due to globalization by allowing a new balance between the State and the Individual on the international plane. We then show that the classical model of democracy based on the State is being superseded by a democracy based on transnational civil society. Finally, we discuss the essential role of the judge to preserve democracy and rule of law in the international order, despite the limitations inherent to his competences. Today, they are subject to various constraints and opportunities, and face many territorial transformations. These transformations are complex and multifaceted. They involve the adoption of new production and consumption modes, the modification of forms of social organisation and identity and territorial claims. However, the links between these on-going processes are still poorly understood, and make difficult to appreciate the adaptation dynamics of indigenous common natural resources management. This thesis is particularly concerned with the territorial dynamics of the Wayãpi and Teko indigenous people of the municipality of Camopi in French Guiana. It integrates methods that include land use analysis using remotely sensed data, socio-economic and agricultural systems analysis at the household scale, and empirical analysis on the influence of identity claims, kinship networks, and conservation policies. It shows that despite the residential settlement around local towns, the growth of cash income from wage labour and welfare, associated with strong kinship networks, allows the revival of mobility and the diversification of indigenous territorialities. Environmental policies implemented on the territory involve processes of identity and territorial claims and motivate the construction of a collective project of endogenous local development. A comparative approach with the situation of the wayãpi people living in Brazil and evolving in a completely different institutional, socio-economic and environmental context shows similar dynamics. Indigenous peoples of these two sites adopt "multi-local" land use systems, allowing them to extend their territory occupation and taking part of a broader dynamic of territorial and identity affirmation. They articulate forest and local town environments. This multi-local land use system can be interpreted as a new form of environmental governance, which overcomes the access difficulties to natural resources around local towns and ensures their sovereignty over the territory. Les territoires amérindiens couvrent de vastes étendues de forêts tropicales et possèdent une forte valeur sociale et environnementale. Soumis à des contraintes et opportunités variées, ils sont de nos jours le siège de nombreuses transformations territoriales. Ces transformations sont complexes et multiformes. Elles impliquent l'adoption de nouveaux modes de production et de consommation, le réajustement des formes d'organisation sociale et des dynamiques de réaffirmation identitaire et territoriale. Or les liens entre tous ces processus sont encore mal compris, et rendent délicate la compréhension des dynamiques d'adaptation des systèmes amérindiens de gestion des ressources communes. Small Island States: Vulnerable, Resilient, Doggedly Perseverant or Cleverly Opportunistic? However, the option to migrate is increasingly fraught by the regulations of the receiving countries, wary of heightened security concerns, stagnating economies and rising xenophobia. Comparisons with subnational island jurisdictions, which treasure their autonomy but are not interested in full sovereignty, are instructive. Elle permet d’étudier la pénalisation de la vie internationale. Elle semble pouvoir rendre compte de la réponse judiciaire à la rancœur internationale au regard des grands faits criminels ; quel qu’en fut le territoire de commission.Cette thèse porte sur la notion de recevabilité devant la Cour pénale internationale. Avec la création de la CPI, la justice pénale internationale prend une dimension nouvelle. La pratique de la Cour est encore récente. L’étude est le prétexte pour examiner le fonctionnement de la Cour pénale internationale. Les Etats ont tenté de limiter la capacité de recevoir de la Cour. Ils l’ont ainsi fondée sur le principe de la complémentarité. Elle supplée l’inaction ou l’action défaillante des Etats, qui ont le devoir de poursuivre les auteurs de crimes internationaux. L’article 17 du Statut de Rome énonce les exceptions permettant de déclarer une affaire recevable devant la CPI. Ainsi, la recevabilité d’une affaire ayant fait l’objet d’une enquête ne sera retenue que s’il est prouvé que les Etats n’ont pas l’intention de mener véritablement à bien les poursuites. Et, que par ailleurs, le seuil de gravité de l’affaire est atteint. Le caractère universel de la compétence de la CPI est battu en brèche par les conditions de recevabilité. On analyse la recevabilité comme une condition de compétence à juste titre, car c’est bien le manquement de l’Etat à assurer l’effectivité des poursuites qui justifie que l’affaire soit déclarée, par la Cour elle-même, recevable. Les conditions requises pour que la Cour puisse agir, force est de constater l’implication du système de recevabilité tant sur l’organisation de la Cour que sur ses rapports avec les Etats. Celles-ci ne sont pas négligeables. De fait, le système de recevabilité est amené à évoluer. Il se caractérise par sa capacité à influencer le droit interne. Ainsi, la décision de recevoir doit amener les Etats à adapter leur droit interne. La viabilité de la Cour, à long terme, dépend du maintien d’une synergie de coopération avec les juridictions nationales, des États parties et d'autres Etats. Le système de recevabilité tend à mettre en évidence des indicateurs émergents dans la pratique de la Cour pénale internationale. C’est notamment le réalignement frappant des rôles des acteurs internationaux et la relation nouvelle qui s’instaure entre les Etats et la Cour. Le système de recevabilité de la Cour tend à éroder le principe de la souveraineté de l'Etat, sans être elle-même balayée par l'opposition catégorique des Etats souverains. Admissibility is the heart of the judicial process. It studies the criminalization of international life. It seems to account for the judicial response to the international resentment against the great criminal acts, whatever was the territory of commission.This thesis deals with the notion of admissibility before the ICC. With the creation of the ICC, International Criminal Justice is a new dimension. The practice of the Court is still new. The study is an excuse to investigate the operation of the ICC. States have tried to limit the ability to receive from the Court. They did so based on the principle of complementarity. It compensates the action or inaction of failing states, which have a duty to prosecute international crimes. Article 17 RS sets out exceptions to declare a case admissible before the ICC. Thus, the admissibility of a case which is the subject of an investigation will be accepted only, if it is shown that States did not intend genuinely to carry out prosecutions. And that furthermore, the threshold of gravity of a case is reached. The universal nature of the jurisdiction of the ICC is undermined by the conditions of admissibility. Analyzing the admissibility of competence as a condition rightly, for it is the failure of the state to ensure effective prosecution to justify that the case will be declared by the Court itself, admissible. The requirements for the Court to act, it is clear involvement of the system of admissibility as on the organization of the Court that its relationship with the United States. These are not insignificant. In fact, the system will evolve admissibility. It is characterized by its ability to influence the law. Thus, the decision to receive should encourage States to adapt their domestic law. The viability of the Court, in the long run depends on maintaining a synergy of cooperation with national courts of States Parties and other States. The system of admissibility tends to highlight indicators emerging in the practice of the International Criminal Court. This is especially striking realignment of the roles of international actors and the new relationship established between the States and the Court. La petite agriculture saint-lucienne et martiniquaise face aux défis de la modernisation Auteur(s) : Miatekela, Jean Auteurs secondaires : Antilles-Guyane Burac, Maurice Résumé : L’importance du rôle des petites agricultures dans les processus de sécurité alimentaire et de souveraineté alimentaire est de plus en plus reconnue. A Sainte-Lucie comme en Martinique, un certain nombre d’acteurs s’engagent officiellement pour une agriculture diversifiée s’appuyant sur les préceptes du développement durable. C’est en tenant compte de ce contexte qu’en partie l’idée de réaliser une étude sur la petite agriculture de Sainte-Lucie et de la Martinique a germé. Aussi, le présent travail se veut-il avant tout une contribution au diagnostic de la petite agriculture face à la modernisation des systèmes agricoles intensifs dans chacune de ces deux îles. Il s’agit de mettre à l’évidence les richesses et les insuffisances de cette petite agriculture, mais aussi les atouts et les contraintes de l’environnement. En grande partie elle prend appui sur le jardin créole, système agricole considéré par bien d’acteurs comme un fondement culturel et une base culturale. Dans chacune des deux îles, beaucoup de petits agriculteurs font de la biodiversité une composante primordiale de la gestion de leurs systèmes agricoles. Les enjeux visés ici portent sur la contribution d’une gestion optimale de cette biodiversité à la promotion des agrosystèmes paysans durables à différentes échelles spatio-temporelles. Dès lors, tout dépend des méthodes d’accompagnement des agriculteurs à mettre en œuvre. Va-t-on poursuivre avec des approches descendantes basées sur la logique de transfert ? Si non, le moment n’est-il pas venu de réunir les conditions pouvant permettre la mise en œuvre des véritables démarches de co-construction ? The important role of small farmers in the process in food security and of food sovereignty is increasingly recognized. In St. Lucia as in Martinique, a number of actors officially committed to a diverse agriculture based on the precepts of sustainable development. It is in the light on this context that partially, the idea of a study on small holder St Lucia and Martinique germinated. Also, the present work is first and foremost a contribution to the diagnosis of small-scale agriculture to modernization of the intensive agricultural systems in each of these two islands. It is put clearly the richness and the inadequacies of this small scale-agriculture, but also the advantages and constraints of the environment. In large part it builds on the creole garden, agricultural system considered by many actors as a cultural foundation and a base of farming practices. In each of the two islands, many small farmers make biodiversity an essential component of management of their farm systems. The stakes referred here relate to the optimal management contribution of biodiversity to promote sustainable peasant agro-ecosystems at different spatial and temporal scales. Therefore, everything depends on farmer coaching methods to set up. Will we continue with down approaches based on logic of transfer ? Cette mutation n’a pas toujours été en phase avec les processus de développement économique national et le changement du contexte international. Le modèle socialiste de la gestion des affaires économiques qui a prédominé à partir du milieu des années 60 jusqu'au milieu des années 80 a progressivement cédé la place à un retrait graduel de l'Etat du champ économique. On assiste, depuis, à une émergence d’un secteur privé qui tente toujours de trouver sa place, à une vague de privatisations, à une libéralisation du commerce extérieur et à un appel aux capitaux étrangers pour financer le développement économique.Cette volonté manifeste d’accéder à une économie de marché est encore plus perceptible dans le dernier code des investissements de 2001. Ces efforts de mise en conformité du droit interne des investissements avec le droit international des investissements sont relayés par un discours politique offensif.Néanmoins, cet environnement juridique incitatif perd de son attrait lorsqu’on le confronte, soit aux textes promulgués en matière de réglementation du commerce extérieur et la réglementation des changes, soit à l’environnement administratif dans lequel est mis en œuvre l’ensemble de ces textes de lois. Cette confrontation est particulièrement instructive quant à l’insuffisance de cohérence de la politique étatique suivie en matière d’investissement étranger. Ceci révèle la balance d’intérêt des autorités algériennes entre l’augmentation de la contribution des investissements étrangers au potentiel économique et technologique national et la sauvegarde de la souveraineté nationale.Ainsi, le questionnement de la politique législative algérienne d’investissement permet de comprendre les fondements de la doctrine algérienne des investissements étrangers. Cette compréhension favorise l’émergence d’une stratégie qui concilie attractivité et préservation des intérêts publics.
